Minister Lenia Batres Guadarrama came forward, but backed down. He published a video defending his vote against the IMSS guaranteeing cochlear implants, prostheses and orthoses to minors with hearing disabilities. Hours later, he deleted it. What happened?
“Absurd” and “contradiction”, according to the self-proclaimed “Minister of the People”
In the clip, Batres described the Supreme Court’s resolution as “absurd” and a “contradiction.” Their argument: the rule only benefits children and adolescents, not adults. “Social rights must be universal,” he said. But the declaration of unconstitutionality 13/2025 excludes adults and those who were born without hearing.
“If we do not have the power to legislate, we should not legislate. But if we do not also have the power to review the budget… our resolution does not end up being feasible,” he stated.
The drama of the budget vs. the rights
Batres insisted that ministers must be “legally measured” and not act without knowing the state budget. “We could not presume that the IMSS has the material and financial capacity to provide these inputs on a generalized basis,” he argued. Their call: avoid “entitlement expectations” that will not be met.
Legal activism or lack of sensitivity?
The minister defended herself: “All people in conditions of social inequality have my legal activism.” But the hard fact is this: the resolution was approved by a majority of seven ministers. Only she voted against. And his video, which sought to explain his position, disappeared from the networks. Pressure? Repentance? The doubt remains.
The truth is that the discussion is not minor: where is the limit between budgetary viability and the right to health of the most vulnerable? Batres chose the first path. But by deleting the video, perhaps he understood that, in politics, explanations sometimes hurt more than silence.
