Analysis of the ruling against the tariffs imposed by the United States
The United States International Trade Court issued a decisive verdict by invalidating the 25% tariffs imposed in March by then-president Donald Trump on imports from Mexico, Canada and China. According to the resolution, published this Wednesday, the measure exceeded the executive’s legal powers by invoking the Emergency Economic Powers Act (IEPPA) of 1977, without demonstrating a direct connection to the fentanyl crisis it was intended to combat.

In February 2024, Trump declared a national emergency arguing the uncontrolled trafficking of this synthetic drug, responsible for more than 74,000 deaths that year. Under this framework, it applied taxes on imported products, alleging diplomatic pressure. However, the Court highlighted in its ruling: “No matter how successful the strategy is, it does not meet the legal criteria to ‘deal’ with the emergency”. The decision responds to lawsuits filed by companies and states governed by Democrats, who questioned the arbitrary use of the IEPPA.
In April, the Trump administration adjusted tariffs to exclude goods covered by the T-MEC, affecting only 50% of Mexican imports. However, the Court also annulled similar fees imposed on other countries on April 2, based on the same law.
