Civil organizations question the performance and autonomy of the CNDH
A prominent group of civil society organizations specialized in fundamental rights has issued a critical evaluation of the performance of the National Human Rights Commission (CNDH). The central point points to a loss of relevance as an autonomous body and an apparent alignment with the discourse of the Federal Executive, particularly in the management of deep crises such as systematic torture and the epidemic of disappearances that affects the country. This stance, according to critics, erodes its essential function of being an independent counterpower.
In a recent analysis, the Miguel Agustín Pro Juárez Human Rights Center (Prodh Center), an institution with a renowned track record, accused the defense organization of supporting public policies that contravene international standards. Likewise, it holds him responsible for minimizing serious violations of individual guarantees and for discrediting the scrutiny of key international mechanisms, such as the Committee against Forced Disappearances of the United Nations. This dynamic, they warn, weakens the comprehensive protection system.
The discrepancy between complaints and concrete actions
The criticism is based on concrete data. According to the Prodh Center, although the CNDH registered 980 complaints pointing out the Mexican Armed Forces as allegedly responsible for human rights abuses, the institutional response has been limited. The agency only issued one general recommendation and eleven for serious violations, most of the latter related to events that occurred in previous government administrations. This disparity raises doubts about the effectiveness and rigor in the supervision of the authorities in office.
The institutional defense of the CNDH and its vision
Faced with these accusations, the president of the CNDH, Rosario Piedra Ibarra, has come forward defending the management. Piedra assures that Mexico is going through a historic stage of consolidation of human rights and argues that the Commission has recovered its role as an authentic defendant of the people. It emphasizes a preventive vision and closeness to victims, distancing itself from a purely reactive model based only on complaints.
In the framework of the commemoration of International Human Rights Day, the national ombudsperson maintained that the organization is not limited to addressing complaints and issuing recommendations. He stated that his work focuses on structurally reducing violations and promoting daily respect for individual guarantees, all guided by principles of legality, professionalism, objectivity and transparency. In addition, he highlighted initiatives in the prevention of gender violence and the support of native peoples, defenders of the territory, young people and older adults.
The pending challenge: recovering the role of counterweight
Despite the institutional defense, the specialized NGOs maintain their questions. The core of the warning is that the real challenge for the CNDH lies in recovering its unequivocal role as counterweight to political power and in guaranteeing effective, impartial and rigorous surveillance of all authorities. This is considered vital, especially in the investigation and punishment of serious violations of human rights, where independence is non-negotiable. The credibility of an institution of this nature depends on its ability to criticize and correct power, regardless of who exercises it, to strengthen the democratic rule of law.
This debate highlights a fundamental tension in the architecture of human rights: the necessary distance between protective agencies and the governments in power to exercise credible oversight. The evolution of this institutional conflict will mark the effectiveness of the protection system in Mexico in the face of complex security and justice challenges.
