Abelina López seeks legal protection following a complaint from the ASE
The mayor of Acapulco, Abelina López, has filed an injunction before federal justice after the Superior State Audit Office (ASE) of Guerrero criminally reported her. The accusation focuses on the lack of verification of 898 million pesos corresponding to federal resources managed by his administration during 2023.

During an interview, conducted after the launch of a beach cleaning program with Governor Evelyn Salgado, López stated that he has not received official notification from the State Prosecutor’s Office about the complaint. However, she decided to act preventively: “In Guerrero anything is possible,” she declared when questioned about her decision to file the amparo without prior notification.
When asked if she would request a license to avoid harm to the municipality, the official responded firmly: “There is no harm, the rest is the black Warrior. I am free of everything.” Her statements were interrupted by her escorts pushing journalists who were trying to approach her, while she added: “He who owes nothing, fears nothing.”
Competence dispute and accusations of politicization
López argued that the Superior Audit of the Federation (ASF), and not the ASE, is the entity empowered to audit the federal resources assigned to the municipality. The complaint revolves around the Contribution Fund for Social Infrastructure (FAIS), whose funds were not properly verified. The mayor called the process a “political issue” and called for a citizen march in her support, although without a defined date.
“It is not the responsibility of the ASE to audit federal resources, but in Guerrero it seems that there are no letters,” López criticized, insinuating an irregular handling of the case. Despite having constitutional jurisdiction – which requires the approval of Congress for its violation -, he chose to go to a federal judge as a precautionary measure.

The case could escalate to an institutional conflict between the state and federal levels, especially if the inadmissibility of the ASE to audit federal funds is confirmed. Legal experts point out that, if the protection is successful, the criminal complaint would be ineffective, but public scrutiny over the management of resources persists.
