Unanimous decision
The Supreme Court of Justice of the Nation endorsed the participation of the Secretariat of National Defense in tasks of surveillance and protection of Mexican airspace. Thus validating a presidential decree published in 2023, during the AMLO government.
Unanimously, the plenary session of ministers determined that the intervention of the Defense in aerial surveillance actions does not contravene fundamental rights. This despite unconstitutionality actions promoted by federal legislators that questioned both the content of the reform and the legislative process.
Irregularities ruled out
The minister rapporteur Arístides Guerrero García maintained that there were no irregularities capable of invalidating the legislative procedure. Although the Senate session was held in an alternate location in Xicoténcatl and alleged quorum failures were reported, the Court considered that they did not affect the validity.
The 2023 legislative session was marked by the accelerated approval of various opinions and protests by opposition legislators. Senator Xóchitl Gálvez chained herself to the desk of the Senate Board of Directors as a sign of disagreement.
Extinction of Financiera Nacional
In the same session, the Court also validated the extinction of the National Financial Institution for Agricultural, Rural, Forestry and Fisheries Development. He considered that the disappearance of the organization does not violate rights nor does it affect access to public programs for the rural sector.
