President Claudia Sheinbaum celebrated the decision of the Supreme Court of Justice of the Nation (SCJN) that declared the crimes linked to the ABC Daycare case not statute-barred. He considered it a key step towards justice for the victims and their families.
Court Decision
During his morning conference, Sheinbaum announced that he will ask the attorney general to publicly report on the scope of the resolution. He said:
“We are going to ask the prosecutor so that she can publicly provide more information about the implications of this Court resolution, which in effect ruled that the crime should not prescribe, which was a request from parents of the ABC Nursery.”
The president linked the ruling to the new integration of the highest court, elected by popular vote. He stated that a previous Court would hardly have ruled in the same way.
“I don’t think the previous Court would have ruled as the Court ruled yesterday. I think this speaks of the sensitivity of ministers who were elected by the people,” he said.

The fire at the ABC Daycare in Hermosillo, Sonora, occurred in 2009. It left 49 minors dead and more than a hundred injured. Sheinbaum called the ruling “historic” for taking into account the victims’ demands.
“Now we are talking about a new Court that makes this resolution, which is truly historic. And it is good that the Court takes into account what the victims say in this case,” he expressed.
The president avoided anticipating criminal responsibilities. He stressed that it will be up to the justice institutions to determine the legal consequences. “The important thing is resolutions that go in the direction of doing justice. That is the function of the Court,” he concluded.
