Mexico establishes a comprehensive legal framework against electronic cigarettes
The president of Mexico, Claudia Sheinbaum Pardo, confirmed and celebrated the legislative decision that endorses the absolute prohibition of the production, marketing and sale of vapers in the country. During her morning conference at the National Palace, the president highlighted the serious risk to public health that these devices represent, denying the common perception that they are a less harmful alternative to traditional tobacco.
“Vapers cause significant harm to health. There is an erroneous notion that by not consuming conventional cigarettes and using a vape instead, the damage is less. The reality is that the vape contains a considerable amount of chemical substances and materials that cause considerable harm,” argued Sheinbaum. This position is now supported by a constitutional change and its subsequent implementation in the General Health Law.
Criminal and economic sanctions for offenders
The legislative reform, approved by the plenary session of the Chamber of Deputies with 324 votes in favor and 129 against, introduces drastic sanctions. Those who manufacture or market electronic cigarettes or similar devices will face penalties of one to eight years in prison. Additionally, a financial fine equivalent to 100 to 2,000 times the daily value of the Measurement and Update Unit (UMA) will be imposed, which may amount to a figure greater than 226,280 pesos.
The president pointed out that it is now up to the Secretary of Health to organize the operational and surveillance logistics to guarantee the effectiveness of the rule. This sanctioning framework seeks to completely discourage the supply chain of these products, considered high risk.
Scope and technical definition of the prohibition
The modification to the General Health Law is exhaustive in its definition and scope. It is established that electronic cigarettes and vapers are mechanical, electronic or any other technology systems designed to heat, vaporize or atomize toxic substances, with or without nicotine, other than tobacco, for inhalation by users.
Article 282 Quater of the law is categorical: “The acquisition, preparation, conservation, production, manufacturing, mixing, conditioning, packaging, transportation for commercial purposes, storage, import, export, trade, distribution, sale and supply of electronic cigarettes, vapers and other similar systems or devices is prohibited throughout the national territory.” This broad wording closes any possible legal loophole and includes all phases of the chain, from manufacturing to delivery to the final consumer.
This decision positions Mexico among the countries with the most restrictive legislation regarding vaping devices, aligning with warnings from international health organizations about the dangers of inhaling aerosols that contain nicotine, flavorings and other ultrafine particles. The measure reflects a primary prevention approach, prioritizing the protection of the population, especially young people, in the face of the documented risks of addiction and lung damage associated with these devices.
