Repep: A Legal Mechanism Against Advertising Intrusion
The proliferation of unsolicited commercial communications represents a significant violation of the privacy and tranquility of citizens. Aware of this problem, the Federal Consumer Attorney (Profeco) has implemented a legal and operational tool designed to give the population effective control over this type of intrusions. This analysis examines in depth the Public Registry to Avoid Advertising (Repep), breaking down its regulatory framework, its practical operation and the detailed procedure for its activation.
Background and Scope of the Public Registry to Avoid Publicity
The legal basis of Repep was established for the first time in the Federal Consumer Protection Law in 2004, although its implementation did not materialize until 2007. This gap between the regulations and their implementation highlights the complexity of articulating a system of these characteristics. The primary objective of this instrument is to provide proactive protection against unwanted telephone marketing practices. According to the most recent data provided by Profeco, the Repep database houses approximately 377,000 registered telephone numbers, with a history of around 3,000 complaints processed, which indicates a level of adoption and use by citizens.
It is crucial to understand the limitations inherent to this mechanism. Its jurisdiction is specifically limited to advertising calls coming from marketers and companies of general goods and services. Communications originating from entities in the financial sector, such as banks, insurance companies, afores or credit information companies are expressly excluded from its scope of action. For the latter, the competent authority is the National Commission for the Protection and Defense of Users of Financial Services (Condusef), which has its own registry to suppress unwanted financial advertising. This distinction is essential for the correct application of consumer defense resources.
Methodology for the Registration and Effectiveness Process
Registration in Repep has been conceived as an accessible procedure, offering users three different ways to do it, thus guaranteeing greater coverage and ease of use. The first option consists of a phone call, where residents of the metropolitan areas of Mexico City, Guadalajara and Monterrey must dial 9628 0000, while the rest of the country can use the toll-free number 01 800 962 8000. The second way, and probably the most expeditious, is registration online through the official portal: https://repep.profeco.gob.mx/registrar_telefono.jsp. The third alternative is to contact the Consumer Telephone at 55 5568 8722 for Mexico City and its metropolitan area, or at 01 800 468 8722 for the interior of the Republic.
Once the registration process is completed, the effect is not immediate. Profeco establishes a period of 30 days for companies to update their databases and cease commercial communications. This grace period is stipulated to allow suppliers to adapt to the regulations. After this period, if the user continues to receive telemarketing calls, they are entitled to file a formal complaint against the offending company. Importantly, the system offers flexibility, allowing users to check the status of their registration or cancel their registration at any time if they choose, reflecting a design focused on consumer autonomy.
The effectiveness of this resource depends largely on citizen knowledge and action. By registering their line in this registry, consumers exercise a right that legally protects them against an invasive commercial practice, contributing to a more respectful and orderly consumer ecosystem.
